1. Scope of application

The Privacy Statement shall apply only to information that is used and saved by websites operated by Bausch + Lomb. These include in particular (but not exclusively) websites which are available on the following domains: www.bauschsurgical.eu. Herein, these shall be referred to simply as the “website”.

The Privacy Statement shall not apply to data which is collected, stored or processed by the websites of other companies or organisations to which we refer. Bausch + Lomb shall not be not responsible for data protection with such websites. Information about data protection on third-party websites shall be obtained on the respective Websites. With regard to such third-party websites, as well as other companies, pharmacies, health insurance companies, doctors or other such institutions or individuals, we do not adopt their content as our own. In addition, our references and links shall not constitute a recommendation under the law governing therapeutic products, or in any other sense.

2. Basic principles of Data Protection

The protection of your privacy is very important to Bausch + Lomb. Compliance with legal provisions is a matter of course. Bausch + Lomb shall therefore only collect, store, process, and use your personal data in accordance with the data protection laws of the Federal Republic of Germany and the European Union.

The term “personal information” is defined in the Federal Data Protection Act. It includes in particular information such as name, date of birth, -mail and home addresses, or phone number, i.e. data that serves to identify a person.

3. Collecting, saving and using personal information

Webpages and services operated by Bausch + Lomb can be visited predominantly without there being any need to disclose personal data.

Bausch + Lomb shall not save any personal data belonging to website users without the consent of the person concerned. If personal data is collected, Bausch + Lomb shall inform the users in detail about the type of data that has been stored, and the purpose of storage and processing.

However, some services shall require registration. In these cases, a form must be completed on the selected website, in which some fields must to be filled in (for example, email address for inclusion in a newsletter), and others can be filled in voluntarily. In some cases, the visitor must choose a username and a password. If required (i.e. mandatory) fields in a form are left empty, the access to the selected website shall usually be denied. As a result, the visitor shall not be able to see the corresponding stored content, neither shall Bausch + Lomb be able to edit or reply to the visitor's enquiry. Under the law governing therapeutic products, some services that require registration shall be reserved for professional circles only.

If the user enters personal data into the website's forms, this shall be taken to mean that the user consents to the collection, processing and use of their data for the purpose for which the user enters this data in the form.

IP addresses shall also be stored for purely statistical purposes and without notice. By using the websites of Bausch + Lomb, the visitor shall agree to the storage of his or her IP address. However, no personal data shall be stored which contravenes §§ 14 and 15 of the German Telemedia Act, which covers inventory data or usage data.

Bausch + Lomb shall collect personal information only to the extent necessary for the stated purposes and in accordance with the applicable legal requirements (in particular documentation and storage obligations).

4. Usage of Personal Data

Bausch + Lomb shall store and process personal data only for purposes for which the persons it affects will be duly informed in each case, or were duly informed about during their registration; unless it is expressly permitted or required that the information be stored and processed for other purposes.

Among other things, personal data can be used to provide customers with information or to recommend products, and to communicate with customers for any other purpose.

5. Confidentiality and disclosure of personal information

Bausch + Lomb shall not sell personal information to third parties outside the Bausch + Lomb, or forward or otherwise make it available to such parties, for a fee or otherwise, to the extent this is mandated by the law or the authorities.

Even within the Bausch + Lomb Group, Bausch + Lomb shall share their data only with allied companies in the European Union or in the USA, as is legally permissible and consistent with data protection standards in the European Union.

Regardless, Bausch + Lomb shall still be entitled to use third parties to process personal data in accordance with regulations on behalf of Bausch + Lomb. Bausch + Lomb shall ensure that the data to be made available to third parties shall be used and processed solely for the purpose referred to on the websites of Bausch + Lomb, or in this Privacy Policy, and in compliance with the statutory data protection regulations and contractual agreements.

If personal data is passed on to other group companies of Bausch + Lomb Group or to third parties who are resident in a country whose data protection standard does not correspond with that of the European Union, Bausch + Lomb shall take care to ensure that these third parties shall observe data protection standards on par with those of the EU.

In order to protect personal data, Bausch + Lomb has taken technical and organisational measures to ensure that the process of collecting, storing and processing your data is secure and confidential.

8. Data of minors

Bausch + Lomb shall not knowingly store, use or disclose to any third party any information on minors without prior consent via direct contact with their legal representatives.

9. Statistical analysis/cookies

Bausch + Lomb shall use standard evaluation techniques to analyse the number of visitors to the websites (e.g. IP address, date, time), to better match their content to customers' needs. The data stored shall therefore be anonymous, or names shall be changed, meaning that individual visitors shall not be identified.
